Nephew on the Fraudulent Case for Wars Past and Present

Thomas Nephew thinks out loud about the basis for impeachment. In light of the Bush team — with the Democratic Congress’s help — retroactively making some of its lawbreaking officially legal, what should the focus of impeachment proceedings be? Nephew concludes that it should be the fraudulent case for this war — and the next one.

    Thanks for the mention! “Thinking out loud” is about right; I’d love to find out there’s less to worry than I thought about re the MCA and the FISA fix; the latter is certainly an indicator of ongoing *political* reluctance to cross the Bush admin, but it may also have poisoned the well for impeachment on those particular grounds.

    I just don’t know for sure; for one thing, the impact of the FISA fix is still somewhat up for debate; for another, it’s sunsetted. I’d really like to run my concerns about the impact of the MCA and the recent FISA bill by someone like Bruce Fein or Elizabeth Holtzmann — ie, someone who is pro-impeachment but has a lot more legal and constitutional expertise than I do.
