This sounds a lot like what I posted about under both the sections you had regarding the millile firing and the assassination not raising constitutional issues.
The BEST part is that the individual was not considered an enemy combatant until AFTER he was killed… anyone want to win a lawsuit against the U.S. government? There’s your fulcrum, enjoy the leverage.

My favorite part was about how Bush could simply declare the Democratic nominee in the next election an enemy combatant and have him killed. Sure; you’d like to think he wouldn’t actually do that, but the point is that according to the way he’s talking, he’s asserting that he has precisely that power should he choose to use it. As citizens, we just have to hope he doesn’t choose to do so.
Please, Mr. Bush, I’ve been really good this year. Can I have my country back for Christmas?
